MOSCOW, June 27 (RAPSI) - Russian courts will take into account the rulings of the European Court of Human Rights (ECHR) - not only in cases against Russia but also in those involving other countries - where the circumstances of cases and the laws applied are similar to Russian law, the Supreme Court said on Thursday.

The Supreme Court has adopted the final version of a resolution on the application of the European Convention for the Protection of Human Rights and Fundamental Freedoms.

The previous version of the document stipulated that the ECHR position should be taken into account if a Russian court is considering a case similar to the one considered by the Strasbourg court.

The final resolution adds another prerequisite: the Russian laws regulating the relations involved in the case must be similar to those analyzed by the ECHR and used as a basis for its decision.

The recommendation to courts to use Russian laws over international law where Russian laws call for higher levels of human rights protection has remained unchanged.

The final resolution also includes a recommendation to judges to read ECHR decisions in Russian through the International Law resource developed by the Supreme Court, as well as permission to use the European court search engine, HUDOC.
