MOSCOW, November 2 - RAPSI, Dmitry Shchitov. An appellate court has registered a prosecutor's appeal against an adverse judgment in his lawsuit to prohibit Metro Cash & Carry to use the Qolsharif Mosque images in its adverts, the court told the Russian Legal Information Agency (RAPSI).

The court has yet to schedule a hearing date.

Metro Cash & Carry is a trading division of the German METRO Group, a world's leading small-scale wholesale chain. It operates 57 Metro Cash & Carry stores in Russia.
On October 12, the Tatarstan Commercial Court held against Kazan prosecutor Rafkat Urazbayev in his lawsuit against Metro Cash & Carry.

The prosecutor sought the administrative liability for the defendant for trademark violation. The prosecutor believes that the mosque image used in the retailer's catalogue is confusingly similar to the Kazan Kremlin museum preserve's trademark, which has been registered earlier.

However, the court decided that Qolsharif Mosque image is associated with the mosque itself rather than with the trademark registered for the Kazan Kremlin. So customers will unlikely be confused and misled by the image.
