MOSCOW, November 23 - RAPSI, Natalia Belova. A commercial court has adjourned on Wednesday until November 29 its hearing of the Beryozka Cluster Home Community's lawsuit against Moscow government for $216 million, the Russian Legal Information Agency (RAPSI) reports from the courtroom.

The action stems from a contract for multi-purpose complex construction dated December 29, 2005.

Beryozka seeks six billion rubles ($193 million) in lost profit. It also wants to collect over 301 million rubles ($9.7 million) in actual damages and to return another 303 million rubles ($9.75 million), that it invested under the contract, plus interest. Furthermore, Beryozka requests to terminate the contract.

The plaintiff adjusted its claim on several occasions. Initially Beryozka sought 4.676 billion rubles ($150 million).

The defendant disagreed arguing that it deems the contract null and void as it was concluded in breach of the law.
