MOSCOW, February 15 - RAPSI. The Supreme Commercial Court presidium has satisfied the watchdog's application by invalidating the withdrawal of funds by mobile service providers from a client account to pay such client's debt under another account.

The Supreme Commercial Court dismissed the lower courts' decisions. Earlier a court satisfied an MTS' claim to invalidate the resolution of the Federal Service for Supervision of Consumer Protection and Welfare which banned funds withdrawal from clients' accounts.

The watchdog appealed the ruling in the Supreme Commercial Court.

By applicable laws payment for services is collected under a definite contract. If the client defaults, the operator is entitled to stop services until the payment is received.

However, the operator is not allowed to stop rendering services under one contract if the client defaults under another one.

Moreover, since the contract is standard the client just cannot negotiate its terms and this was the reason to turn to the regulator for assistance.
