MOSCOW, February 15 - RAPSI. The Ninth Commercial Court of Appeals has upheld a judgment awarding the Mosenergo power generating company $18 million in debt from MOEK.

The court has dismissed the defendants' appeal against the award.

At first, the amount in claim stood at more than 8 billion rubles, but MOEK partially paid the debt. Eventually, the court recovered under its lawsuits 564 million rubles ($17.9 million), 843.3 million rubles ($ 26.76 million), 429.1 million rubles ($13.61 million) and 538.5 million rubles ($17.09 million). The amount included the principal debt and interest.

The Mosenergo said it supplied in June and July energy worth 8 billion rubles ($ 253.9 million) under power supply contracts concluded in 2006 and their extensions.
MOEK filed counterclaims to invalidate contractual provisions establishing energy tariffs.

Mosenergo said the tariffs were set in 2010 and contradicted the laws then in effect. The court dismissed all the counterclaims.

Earlier, the Moscow Commercial Court considered several Mosenergo actions against MOEK, all of which stemmed from its late payment for thermal power supplies. The defendant paid its principal debt after the filings. The court demanded from the company interest payments each time amounting to millions of rubles.

Mosenergo is the largest territorial power generating company in Russia. It comprises 15 power plants with an electrical capacity of 11,000 megawatts and s heat capacity of 34,900 gigacalories per hour.
