MOSCOW, March 30 - RAPSI. The Ostankinsky District Court in Moscow will hear on April 5 two complaints against the investigators' refusal to provide some documents involved in the Magnitsky case to Hermitage Capital investment fund.

The complaints hearing was initially scheduled for Friday, but had to be postponed due to the prosecutor's failure to attend it. Counsel Alexei Moshansky requested the court to declare such conduct inadmissible.

Hermitage Capital said the first complaint contests the investigators' refusal to produce Magnitsky's testimony made at the detention center one month before his death.

The fund believes that he told about the uncovered scheme used by the officials to steal public funds, but investigators conceal the records insisting on their non-existence and continue prosecuting Hermitage Capital's partner Ivan Cherkasov.

The second complaint is against the investigators' refusal to produce the documents which underlay the decision to refer the case to the Interior Ministry for further investigation. The documents refer to "multiple requests from political public organizations" without specifying the organizations and their requests motivation. Meanwhile investigators just ignored the opinion of the presidential human rights council which declared prosecution against Magnitsky unlawful. In the complaint lawyers demanded copies of such requests.

Magnitsky, an auditor for the Hermitage Capital Management Fund, was charged with involvement in a large-scale corporate tax evasion. He died in a Moscow pretrial detention center on November 16, 2009, after spending nearly a year behind bars.

According to investigators, Magnitsky and his accomplices stole hundreds of millions of rubles from the state by manipulating tax returns between September and October 2007.

In turn, Hermitage Capital maintains that it has paid the 5.4 billion rubles ($182.75 million) in taxes, but the money was stolen by corporate raiders with the help of law enforcement officials. Magnitsky's prosecution has been attributed to this theft.
