MOSCOW, May 11 - RAPSI. A Moscow court has refused to accept a lawsuit for consideration filed by former Health Minister Yury Shebchenko against Kirill I, Patriarch of Moscow and all Russia, over his alleged unjust enrichment.

This is Shevchenko's third legal battle with his neighbor Lidia Leonova, who has sued him twice. Reportedly, Leonova's apartment is, in fact, owned by her relative Kirill I (whose secular name is Vladimir Gundyayev).

"Shevchenko requested the court to have the unjust enrichment returned in kind. The objects in question are chairs and carpets. Gundyayev and Leonova have been named as defendants," the court told the Russian Legal Information agency (RAPSI/rapsinews.com).

According to the court press secretary, the statement of claim was rejected because the issue is not subject to civil procedure.

The first action against Shevchenko was initiated by Leonova over the damage caused to her apartment and furniture by the repair works in Shevchenko's apartment on the floor below. After the court ordered him to pay 20 million rubles ($662,500) in damages, she filed another lawsuit contesting the contract of gift for his premises. However, the minister's son sold an apartment in St. Petersburg, paid the claimed amount and the case was closed. Now, under current law, the plaintiff who received full compensation for the damaged chairs and carpets should provide them to the defendant.
