MOSCOW, June 20 – RAPSI. The Moscow Commercial Court has postponed until July 30 consideration of a lawsuit over alleged copyright infringement by MTV Russia. The claim was filed by Lavina Concert company which demands $3,091 for USSR rock star music performance.

The plaintiff believes MTV used Viktor Tsoy's song in a program, thus violating the plaintiff's exclusive rights.

The defendant earlier said in court that it did not use the work in dispute.

During the previous hearing, the court attracted to the case Tsoy’s son Alexander as a third party. On Wednesday, the plaintiff’s representative asked the court to postpone the case, stating that Alexander Tsoy cannot attend the hearings because he is involved in events related to the celebration of his late father's fiftieth birthday.

The court satisfied the application.

Moroz Music Record Company is a third party in the case. The musician's heirs assigned the copyrights to Moroz Music, which in turn eventually assigned them to the plaintiff.

MTV Russia is part of the ProfMedia holding established in 1997.
