MOSCOW, November 21 - RAPSI. The Moscow District Federal Commercial Court has upheld the ruling pursuant to which the court has recognized the Microsoft Corporation's right to the Windows.Ru domain name, the court spokesperson told RAPSI on Wednesday.
The cassation instance has dismissed businessman Dmitry Shapovalov's appeal against the lower instance court's ruling.
The court prohibited Shapovalov, who owns the domain, from using the "Windows" trademark in a domain name for specific categories of products. Shapovalov's website contained information about aircraft, avionics and other equipment that use the trademark.
On April 17, the Moscow Commercial Court recognized Microsoft's right to use the trademark in the domain name for goods of the ninth class of the International Classification of Goods and Services.
Microsoft claimed the right to use the trademark in its domain name and sought to prevent Shapovalov from doing so as well. Microsoft did not specify the class of goods for which it should be prohibited from use.
Microsoft is the world's leading software manufacturer. In mid-November, its market value was $224.9 billion.
