DONETSK, June 5 (RAPSI) - The Supreme Court of Ukraine has scheduled a hearing for an administrative case by Donetsk lawyer Vladimir Olentsevich on legality of the May 25 presidential election, for June 10, Olentsevich told RIA Novosti.

Last March, the Supreme Administrative Court dismissed Olentsevich’s case regarding the legality of granting Verkhovna Rada Speaker Oleksandr Turchynov presidential authority. The judges of the Supreme Administrative Court ruled that the lawsuit, filed on February 28, must be heard by the Constitutional Court of Ukraine. Olentsevich claims that “Yanukovych remains the legitimate president and, under the Ukrainian constitution, the deputies must send all approved draft laws to Rostov-on-Don for his signature.”

In late March, Olentsevich filed another lawsuit on the legality of the Verkhovna Rada’s resolution to schedule a presidential election for May 25 for the same reason: Yanukovych is still the incumbent president. The Supreme Administrative Court returned his statement of claim with a note that the lawsuit falls within the jurisdiction of the Constitutional Court of Ukraine. Olentsevich appealed to the dismissal in the Supreme Court. On April 10, Judge Gusak opened a case to review the ruling of the Supreme Administrative Court.

The pre-term presidential election in Ukraine took place on May 25. The declared winner, Petro Poroshenko, will be inaugurated on June 7.
