MOSCOW, October 30 (RAPSI) – The Supreme Court’s Presidium on Wednesday reversed a sentence of Alexander Borisov convicted of drug possession and ordered his release from detention after the European Court of Human Rights (ECHR) found violations in the case, his lawyer Irina Khrunova told RAPSI.

The man was freed on travel restrictions, the attorney said.

According to Khrunova, in the challenged judicial acts the ECHR pointed several violations against the convict. It was not revealed where Borisov was held from the moment of his arrest to drug inspection, who and how convoyed the man, and how special tools were used against him. The ECHR also pointed that a Russian court failed to check the defendant’s version on circumstances of his arrest and drugs detection.

Thus, the Supreme Court overturned the Moscow Timiryazevsky District Court’s ruling of September 22, 2016 sentencing Borisov to 4 years behind bars and further ruling of an appeals instance upholding the verdict.
