MOSCOW, December 10 - RAPSI. The Investigative Committee has drafted a bill to combat tax evasion schemes carried out by way of fraudulent transactions, Alexander Bastrykin, the Investigative Committee's head, told Rossiyskaya Gazeta daily on Monday.

The Investigative Committee has been dealing with tax crimes since 2010.

The bill proposes imposing a direct ban on abusing civil law in the sphere of tax-evasion. These actions will result in both public and criminal liability, according to Bastrykin.

According to the bill, the definition of "tax optimization" (reduction in the amount of taxes and duties subject to be paid in any manner not forbidden by the Tax Code) will be included in the Tax Code and will be delimited from the tax evasion definition.

"The imposing of a direct ban on taxpayers committing fraudulent business operations and using fly-by-night companies is stipulated in the bill as well," the committee head said.

A new article has been proposed for the Code of Administrative Offences which would establish liability for setting up and/or using fly-by-night companies in one's activity.

Those guilty of violating the article would be prohibited from setting up new organizations.
