MOSCOW, August 25 (RAPSI) - The Moscow Commercial Court has dismissed a lawsuit which was filed by S.B.A. Music Publishing, a subsidiary of Gala Records, against Rostelecom company and the NTV television channel over the alleged infringing copyright for the Blur’s Song 2, RAPSI learnt in the court on Monday.
S.B.A. Music Publishing sought 4 million rubles (over $130,000) in damages.
The company claimed that it owned the rights to the disputed song in the CIS as it was unlawfully used in a Rostelecom advertisement. The ad was placed on a website deemed to belong to Rostelecom and was run on the NTV channel.
The suit was dismissed because S.B.A. Music Publishing did not present evidence that it was the Blur’s Song 2 used in the video, according to a Rostelecom representative.
A representative of NTV said that S.B.A. Music Publishing failed to provide evidence that the ad was run on the channel.
