MOSCOW, October 5 - RAPSI, Alyona Yegorova. An appellate court upheld the dismissal of the watchdog's lawsuit to recover $45.34 million from the Otkrytaya Tekhnologicheskaya Kompaniya lottery operator, the court told the Russian Legal Information Agency (RAPSI).
The Federal Communications Agency concluded a contract with the lottery operator to hold the nationwide lottery. The lottery operator was to allocate targeted deductions from the lottery to the federal budget.
However, the operator did not fulfill its obligations.
At first, the agency claimed that it wanted to terminate the contract and recover the deductions stated in the document. The agency's representative said the operator guaranteed the transfer regardless of whether the lottery drawing would be held.
The operator said the parties signed an agreement on the state contract's termination. Additionally, according to the defendant, the targeted deductions are part of the profit made from the lottery. Thus, the operator asserts that they cannot be transferred, as the lottery was not held.
