The Supreme Commercial Court will not review the lower courts' decisions to dismiss Mirax Group subsidiary's appeal against an adverse judgment in its suit for $63.4 million against the Federal Center for Social Development, the court told the Russian Legal Information Agency (RAPSI/rapsinews.com).
A three-judge panel ruled on December 5 to turn down the request filed by Moscow Engineering Company-SM, the third party to the dispute, to remand the case to the Supreme Commercial Court's presidium for review.
In December 2010 the Moscow Commercial Court dismissed the Mirax-Fili's claim to the Federal Center for 1.972 billion rubles ($63.4 million). The judgment was upheld by the Ninth Commercal Court of Appeals in March and the Moscow District Federal Commercial Court in June 2011.
Mirax-Fili claimed payment for Kutuzov Mile residential quarter renovation it performed for the Federal Center for Social Development in Moscow from July 2008 until December 2009.
The plaintiff alleged that it paid 2.404 billion rubles ($77.3 million) to its counterparties between July 2008 and September 2009, out of which the defendant repaid as little as 485 million rubles ($15.6 million), so its debt now amounts to 1.909 billion rubles ($61.4 million).
The defendant claims it did not authorize further construction on such a scale and at such prices.
The Mirax Group was founded in 1994. The total square area of the companys development projects amounts to 12 million square meters, including 825,000 square meters of completed development.
