DONETSK, September 21 - RAPSI. The Ukrainian Justice Ministry is drafting an appeal against the Kiev Economic Court's ruling pursuant to which $390 million owed by United Energy Systems of Ukraine (UESU) to the Russian Defense Ministry must be paid from the Ukrainian budget, Ukrainian First Deputy Prime Minister Valery Khoroshovsky told journalists in Donetsk on Friday.
Yulia Tymoshenko, who is serving a sentence under another case, is implicated in this case.
The Kiev Economic Court partially upheld the Defense Ministry's suit having obligated the Ukrainian government to pay more than 3.2 million hryvnas ($405.5 million) in UESU debt which arose in 1990s, when the corporation was headed by Tymoshenko. Former Ukrainian Prime Minister Pavlo Lazarenko, who is now serving time for money laundering, provided the Russian Defense Ministry with written guarantees that the debt be paid. The Ukrainian Justice Ministry announced on Thursday that it has determined to appeal the ruling.
The debt arose in the 1990s. The Ukrainian government was the guarantor under the debt.
Tymoshenko headed UESU in the 1990s. In late March, a second case bringing further charges against Tymoshenko was filed with Kharkiv's Kievsky District Court. The case deals with her activity at the company. She has been accused of misappropriation of funds.
In a separate case in October 2011, Tymoshenko was sentenced to seven years in prison for abuse of power based on a 2009 gas contract she signed with Russia. She is serving her sentence in a Kharkiv women's prison. She has been receiving treatment at a Kharkiv hospital since May 2012. She was diagnosed with a spinal disc herniation.
