MOSCOW, September 27 - RAPSI. The Supreme Court has ruled to allow the use of automatic traps for protection against dangerous intruders.
In the Supreme Court ruling on Friday, the principles for justifiable defense were expanded to cover cases involving this type of trap.
At the same time, the judges have stressed that if in such a case the harm inflicted on a trespasser clearly does not correspond to the nature and danger of his or her offence, it should be qualified as an abuse of justifiable defense.
In addition, the court calls for disallowing the infliction of harm on third parties in justifiable defense, as well as in the detention of a potential criminal, the resolution reads.
However, if a third party suffers by the catching of an intruder, the actions of the detainer can be considered a justified or even innocent infliction of harm, or a negligent crime.
