MOSCOW, October 26 - RAPSI. The Third Commercial Court of Appeals has registered the Interregional Distributional Grid Company of Siberia's (IDGC of Siberia) appeal of a lower court ruling that granted the recovery of one billion rubles ($31.84 million) from the Krasnoyarsk Regional Finance Ministry instead of the initially claimed 4.607 billion rubles ($146.69 million), the court told the Russian Legal Information Agency (RAPSI/rapsinews.com).

The company has disputed in the appeals instance the Krasnoyarsk Territory Commercial Court's October 8 ruling, which partially satisfied the plaintiff's claim.

IDGC had initially sought to recover 4.607 billion rubles ($146.69 million) in compensation for its losses.

The lawsuit was filed on February 9. In its claim, the company stated that it sought compensation to offset the losses that it sustained following a uniform electric energy transmission tariff order for 2011, which was issued by the Krasnoyarsk Territory's regional energy commission on December 15, 2010.

IDGC earlier told RAPSI that the commercial court declared the tariffs invalid on December 29, 2011. The company ultimately lost 4.6 billion rubles ($146.69 million) due to these tariffs in 2011.

A claim to recover financial losses was also brought against the Trans-Baikal Territory. The company is determined to recover 250 million rubles ($7.96 million) in damages sustained during the fourth quarter.

IDGC said liability was imposed for economically unjustified rates under similar circumstances in 2005.The Krasnoyarsk Regional Finance Ministry does not agree with IDGC's claims and considers the company's arguments biased. It added that these arguments do not serve as grounds for recovering losses and the amount of these losses remains unproven.

The IDGC of Siberia is a subsidiary of the IDGC Holding. It is the largest electrical power supplier in the Siberian Federal District.
