MOSCOW, March 15 - RAPSI. The Patent Disputes Chamber has confirmed its refusal to register the new McDonald's brand Chicken Bacon, the authority said on its website on Friday.
On August 16, 2012, the Federal Service for Intellectual Property (Rospatent) denied the registration of the new McDonald's brand with regard to products in the Nice Class 30, such as coffee, tea, bakery products, and vegetable products prepared for use or canning.
The authority stated that the word combination is a transliteration of two English words providing information about the product's composition. Thus, they cannot be used as a brand, or be entitled to legal protection and exclusive rights.
The materials the company submitted do not prove the brand's distinctiveness.
Meanwhile, McDonald's believes the proposed brand is distinctive, as it is clearly associated with the producer and the products.
Moreover, it is also original and creative because the word "chicken" has no meaning in Russian, while "bacon" means a salted meat product. Therefore, the brand does not describe the composition or the properties of the designated class of products.
