MOSCOW, March 28 - RAPSI. Bribe-givers will still face charges and will not be able to return a bribe even if they admit to the crime and cooperate with the investigation, according to a Supreme Court panel draft resolution on corruption-related crimes.
The draft resolution stipulates that the individual reporting a bribe will be discharged from liability.
"Freeing a bribe-giver who cooperates with investigators from criminal liability will not imply the absence of a crime in his act," according to the draft resolution. "Therefore, bribe-givers cannot be considered as the victims and they are not eligible to return the valuables used as a bribe."
The document also explains that the money can be returned to the bribe-giver if he had to surrender the amount as a result of mental coercion or extreme necessity. The bribe-giver will also be able to return the money if he reports the extortion to the police before engaging in bribery.
The police will then detain the bribe-taker as the bribe is handed over.
