MOSCOW, July 21 (RAPSI, Oleg Panfilov) – The defense team of suspected Russian hacker Roman Seleznev who claims that he was seized in the Maldives by US Secret Service agents and whisked away to the US has filed a motion to dismiss the case against Seleznev, according to the legal documents obtained by RAPSI.

G. Patrick Civille, an attorney of Civille & Tang PLLC, has asked the Court to “divest itself from jurisdiction over Seleznev, including jurisdiction to order removal, and discharging and releasing him (Seleznev) from custody”. The atorney believes that his client’s presence in the US court has not been lawfully procured.

According to the motion, Seleznev was illegally arrested at the Maldives Ibrahim Nasir International Airport. American agents put Seleznev into the airport’s empty room, handcuffed him and escorted to the private jet heading towards Guam in violation of Articles 45-48 of the Maldives Constitution which , Seleznev's attorney claims.

Mr. Civille also raises the question of the Interpol red notice for Seleznev. “Had an Interpol Red Notice actually been honored, Seleznev would have been taken into the custody of Maldives authorities “with a view towards extradition or similar lawful action”, not for purposes of a governmental abduction carried out by U.S. agents on foreign soil,” the motion reads.

Mr. Civille presented two options: either to admit the lack of jurisdiction over Seleznev by the Guam court or to use the court’s supervisory power to dismiss the case against Seleznev because of alleged international law violation.
