MOSCOW, September 10 (RAPSI) - Chamber for Patent Disputes of the Russian patent agency has confirmed the refusal of an application filed by Sikorsky Aircraft, a subsidiary of United Technologies Corp., seeking to register X2 trademark.
The patent agency states in its ruling that “the applicant’s label consists of a combination of letter ‘X’ and number ‘2’ that are graphically indistinguishable.” The ruling also states that the label could be easily confused with the trademark X2 that was registered by BMW.
The applicant believes that the label, due to its audial and conceptual variation, prompts associations with a mathematical formula, a coordinate axis or helicopter blades. The applicant also claims that he is the sole owner of the exclusive rights to the trademark X2 Technology. In addition, the applicant informed Rospatent of the fact that X2 has been used in the US since December 1, 2005, and, even before the application in Russia was linked to the applicant’s name in the aviation industry.
In summer 2010, the Sikorsky Х2 helicopter set an unofficial world record for helicopter speed, 415 kmph. On July 14, 2011, the helicopter made its last flight, after which the program was announced to be closed. The program tested several new technologies that will be used in the S-97 Raider military jet.
