MOSCOW, September 14 (RAPSI) – The Kalininsky District Court in St. Petersburg will consider a lawsuit filed by an HIV positive prisoner demanding 600,000 rubles ($9,300) from the Federal Penitentiary Service’s (FSIN) hospital for non-provision of medicine, lawyer Vitaliy Cherkasov told RAPSI on Wednesday.
In the fall of 2015, the convict lodged a lawsuit to declare nonperformance of a FSIN hospital’s director illegal. He insisted that he had not been provided with antiretroviral drugs in detention for six months.
In December 2015, the court rejected the lawsuit but left the plaintiff and his representative without notice of holding a hearing.
The convict supplemented the suit not knowing about the court ruling. He demanded 600,000 rubles in compensation for moral harm in his claim.
Threfore, the lawsuit will be reconsidered by the Kalininsky District Court.
The lawyer also added that, according to existing law, his client has a right to release because of grave illness, but courts numerously rejected such motions.
