MOSCOW, October 10 (RAPSI) – The Moscow Commercial Court has dismissed one of Google’s appeals against a ruling of the Federal Antimonopoly Service (FAS), which fined the corporation 438 million rubles ($6.7 mln), RIA Novosti reported on Monday.
A motion to dismiss the appeal was filed by Google itself during preliminary hearings on October 5. The corporation claimed that the court is already reviewing a similar lawsuit by Google that was filed on August 26. Duplication of lawsuits happens to commercial courts because plaintiffs file the same lawsuits in paper and digital forms simultaneously.
On August 17, the Ninth Commercial Court of Appeals has dismissed an appeal filed by Google against a ruling that the US company had broken Russian anti-monopoly legislation by abusing its dominance on the Russian market of mobile applications.
In early August, FAS announced that it had fined Google 438 million rubles for violating administrative legislation.
On September 18, 2015, the Federal Antimonopoly Service (FAS) found Google guilty of violation the legislation.
On March 15, 2016, the Moscow Commercial Court dismissed Google’s petition requesting to abolish the FAS decision and order issued in September 2015, which stated that the company had violated the Federal Law on Protection of Competition and accusing it of abuse of dominance on the market of preinstalled applications in the Android operating system.
