MOSCOW, August 4 (RAPSI) — The Ninth Commercial Court of Appeals is to rule on the issue of the legality of a 906.2 million-ruble (about $12 million) fine imposed by the Russian Federal Antimonopoly Service (FAS) upon Apple Inc. for abuse of market dominance on August 30, according to the case papers.

The American corporation appealed against the decision of the Moscow Commercial Court dated June 6, 2022.

By the said ruling, the court found lawful the FAS decision of August 28, 2020, qualifying Apple Inc. actions as abuse of market dominance. At the same time, the court upheld the decision of the FAS decision of April 27, 2021 as to the imposition of a fine of 906.2 million rubles on the company. In August 2020, the antimonopoly watchdog completed a probe into a case against Apple Inc. opened upon a claim of Kaspersky Laboratory.

FAS revealed that the company abused iOS mobile apps market power by committing certain actions resulting in affording competitive edge to its products and worsening of condition of distribution of the rivals’ products, namely the parental controls application.
