MOSCOW, November 16 - RAPSI, Sergei Feklyunin. The Supreme Commercial Court Presidium dismissed on Tuesday three lower courts' decisions refusing to recover $91,117 in state budget debts from the Niva Voronezh Regional Association of Farms and Agricultural Cooperatives for Rosagrosnab, the court told the Russian Legal Information Agency (RAPSI) on Tuesday.

The debts arose in 2000.

The Supreme Commercial Court Presidium submitted the case for reconsideration to the Voronezh Regional Commercial Court.

Earlier, the presidium referred to the Constitutional Court to establish if the general rule on a three-year limitation period includes requirements to return money to the state budget.

The Constitutional Court validated an increased limitation period for such claims. However, it did not state that it is inadmissible to cancel the limitation period in full. The court required establishing a specific time period for the increased limitation period in such lawsuits.
