MOSCOW, April 27 (RAPSI) – Lack of criminal liability for legal entities in Russia causes problems in need of solutions, Chairman of the Russian Constitutional Court Valery Zorkin said during the first joint commission of investigative committees from Russia, Belarus and Armenia as cited by RIA Novosti news agency.
Zorkin noted that disclosure of violations in economics committed by legal entities without proper investigative and search procedures is very inefficient. He added that in Russia such activities are not possible in the frame of the administrative law as it is only carried out in criminal cases.
According to the Constitutional Court’s Chairman, this problem may be solved in two ways: either investigative procedures should be allowed to be carried out in administrative cases or criminal liability should be introduced for legal entities. He notes that this subject is up for discussions.
In Russia liability of legal entities is written down in the Civil Code and the Code of Administrative Violations, but not in the Criminal Code.
