MOSCOW, June 1 (RAPSI, Oleg Sivozhelezov) – Repeated filing of the same motion after it was dismissed during review of an administrative case may be classified as show of contempt of a court, according to the clarification proposed by Russia’s Supreme Court.
This clarification may be established in a decree on measures of procedural coercion allowed to the courts during review of administrative cases. The document is concerned with the problem of disregard towards rules of behavior for persons participating in the case. The court proposes to treat the use of vulgarities in procedural documents as disrespect too. It is noted that actions leading to administrative or criminal liability should not be treated as disrespect.
The decree is concerned with actions the courts may take against persons violating the rules of the administrative trials. Among these measures are fines, warnings to the participants, removal from the courtroom and other similar matters.
