MOSCOW, September 27 - RAPSI, Dmitry Shchitov. The patent watchdog confirmed its refusal to register the Avatar trademark for a perfume company, the Federal Service for Intellectual Property, Patents and Trademarks (Rospatent) said today.
Parfumeria XXI Veka is a mass market and mid-market perfume producer. It has been operating for over 10 years.
The company requested the patent service to register the Avatar verbal trademark for its cosmetics, soaps and deodorants.
However, the service established that the verbal mark reproduces the name "Avatar," the top-grossing movie directed by James Cameron.
The copyright to the movie was acquired before the perfumery filed its application. The service's decision reads that the designated mark and the name of the movie are identical.
Due to the movie's worldwide fame, using the trademark without permission is illegal, the service said.
Additionally, customers will associate such products with Cameron's movie.
