MOSCOW, November 9 - RAPSI. The Capital Group does not disclaim responsibility for the destiny of owners who purchased apartments in the Yacht City complex in northern Moscow, and will assert the legality of previous court decisions on the recognition of ownership rights to the property.
The Capital Group has operated since 1993. Its portfolio included over 70 projects spanning over 7 million square meters. The company is owned by Vladislav Voronin and Pavel Te.
The complex's construction started in 2004 without the necessary permits. In 2006, the Moscow Commercial Court satisfied the claim of the Volna-Podmoskovye Sport developer, the Capital Group's partner, and ruled that it possessed the ownership rights to the unauthorized construction.
The Moscow Ninth Commercial Appeals Court considered the agency's appeal on October 19 and dismissed the previous decisions.
The Federal Agency for State Property Management said on Tuesday that it would submit a statement of claim to the Moscow Commercial Court on recognizing the complex as an unauthorized construction site and ordering its demolition.
The lawsuit is scheduled to be examined in early December. Additionally, a similar statement by the Moscow Northern District's prefecture is pending.
