MOSCOW, February 20 (RAPSI) – Russia’s Intellectual Property Court (IP Court) has upheld the recovery of 1.2 million rubles ($16,200) from entrepreneur Mars Ibragimov sought by New Balance Athletics company over an infringement of the exclusive right for its brand and banned the respondent to use the respective trademark in 60 domain names, according to the court ruling.
Earlier, the American manufacturer learned that Ibragimov uses its trademark in the names of 60 internet domains he administered across several regions of Russia; the websites offered counterfeit products at prices twice below those of the original manufacturer.
New Balance Athletics attempted to settle the issue under pretrial procedures; after these attempts had failed the company turned to a commercial court.
The Moscow Commercial Court ruled in favor of the claimant on July 23, the decision was upheld by the Ninth Commercial Court of Appeals on November 11, 2020.
