MOSCOW, July 12 - RAPSI. On Thursday the Moscow Commercial Court has found businessman Dmitry Sevyan's registration of the Geox.Ru domain to be a violation of the Italian Geox S.p.A.'s trademark rights, the court told the Russian Legal Information Agency (RAPSI/rapsinews.com).

The court has also invalidated the use of the word "geox" on Sevyan's website to advertise products and prohibited the entrepreneur from using the word in association with products that are subject to the Geox S.p.A. brand. However, the court has refused to recover 100,000 rubles ($3,049) from Sevyan.

It has also dismissed the claims against the registrar, the Regional Network Information Center.

Sevyan commented on the resolution after the hearing and said he may dispute the decision.

"First of all, we will get in touch with Geox," he said.

Earlier, Sevyan said he entered into a contract for exclusive GEOX products distribution in Russia in 2005 and the website was purchased and registered with the company's knowledge. Moreover, an agreement on the website's transfer to Geox S.p.A. was drawn up, he said.

Sevyan added that he has opened over 60 GEOX outlets in Russia.

However, the company offered Sevyan another distribution contract in 2009 with worse terms.

Their cooperation ceased and Sevyan offered to provide the outlets and the website to Geox S.p.A. in exchange for compensating his costs.

Geox S.p.A. was founded in the early 1990s and has been listed on the Italian stock exchange since 2004. The company designs, produces and sells clothes and shoes all over the world.
