MOSCOW, August 2 - RAPSI. Mother of deceased auditor Sergei Magnitsky has appealed against the refusal to remand the case of former Butyrka jail warden Dmitry Kratov back to the prosecutor's office, counsel Nikolai Gorokhov told the Russian Legal Information Agency.
Kratov was charged with improperly executing his responsibility to provide medical aid to the detainees, which resulted in Magnitsky's death.
"We are requesting a reversal of the Tverskoy District Court's July 27 ruling and remanding the case for repeat preliminary review by another panel," said Gorokhov.
Magnitsky was charged with masterminding large-scale corporate tax evasion. He died in the Matrosskaya Tishina pretrial detention center on November 16, 2009 after spending nearly a year behind bars. However, he spent most of his prison time in the Butyrka jail. His death evoked a massive public outcry.
The investigation into his death continues.
According to the Investigative Committee, Kratov's case was separated from the main case over Magnitsky's death.
The investigation has already been completed. Kratov was charged with neglect of duty resulting in death. He faces a five-year custodial sentence. Pending the trial he has been released on own recognizance.
