MOSCOW, April 16 - RAPSI, Maria Petrova. The Constitutional Court will hear a complaint regarding the failure to provide housing compensation to retired military personnel, lawyer Alexander Zorin told RAPSI on Tuesday.
In accordance with the law on military personnel, servicemen who did not receive service housing and retired before Jan. 1, 2005 must be issued monthly housing compensation from the federal budget. Those who live in Moscow or St. Petersburg must receive 15,000 rubles ($480) as partial compensation from their district military registration and enlistment office for rented housing.
However, the plaintiffs claim that legal inequality developed after 2005 in regard to retired officers who had not registered with the housing authorities before Jan. 1, 2005, or who retired after that date. Compensation payments to some military pensioners who retired after 2005 have stopped.
The Meshchansky District Court in Moscow previously ruled in favor of 10 retired officers who demanded compensation payment. However, the city military registration and enlistment office appealed the decision with the Moscow City Court, which reversed the ruling.
The plaintiffs subsequently filed a complaint with the Constitutional Court, demanding that a provision of the law's Article 15 be recognized as running counter to the Constitution and establishing inequality among servicemen.
