MOSCOW, February 28 (RAPSI) – The Supreme Court of Russia has ordered the Kurgan Regional Court’s presidium to review a criminal case against Yevgeniya Chudnovets, former kindergarten teacher, who was sentenced for distribution of pornography by sharing video in a social network, RAPSI learnt from the court's press-service on Tuesday.
The Supreme Court agreed with the arguments of the Deputy Prosecutor General Leonid Korzhinek, who asked to repeal the sentence and close the case against Chudnovets, according to the court’s representative.
On Monday, Chudnovets’ legal team filed an appeal with the European Court of Human Rights (ECHR). Reportedly, she complains that her rights to a fair trial and freedom of expression have been violated.
According to the case documents, Chudnovets published video, where a little child was shown naked, on the Vkontakte social network. Aleksey Bushmakov earlier told RAPSI that this was a video made by someone else, shared by Chudnovets to bring attention to situation in recreational camps for children. She was sentenced to six months in a penal colony.
In November 2016, she was sentenced to 6 months in prison. Later, her prison term was reduced to 5 months.
Prosecutors asked to choose another punishment for Chudnovets, one not related to imprisonment. During the initial hearings prosecutors asked for five years in prison.
