MOSCOW, June 27 (RAPSI) – The Tushinsky District Court of Moscow has registered an appeal filed by a passenger, who was hurt in a road accident, Yelena Grashchenkova, against a ruling partially dismissing her lawsuit against Yandex. Taxi service, the press-service of the court has told RAPSI.
The court earlier granted the lawsuit in part.
According to Grashchenkova, the court refused to acknowledge her business relations with Yandex. Taxi as transportation contract signed through a mobile app. She believes that the company did not provide her with a safe service and believes that Yandex. Taxi is responsible for the passengers’ safety.
The road accident in 2016 resulted in the plaintiff’s grave injuries that left her temporarily disabled. A taxi driver was acknowledged as the guilty party. Grashchenkova sought to recover over 65 million rubles (over $1 million) from the taxi aggregator but the court ruled that insurance company is to pay her 500,000 rubles ($7,900).
Yandex. Taxi believes it is not responsible for safety of passengers since it does not provide actual transportation.
Yet, on June 26, the Supreme Court of Russia upheld liability of taxi aggregators for unsatisfactory rides.
According to the court, a contractor that agrees to transport passengers, luggage and cargo is liable for all the damage that a client may endure during a ride if the client directly signed a contract with this person or legal entity.
The same rule applies if a client, based on circumstances of the contract such as advertisement, believes that he or she signs contract with this service directly and assumes that drivers are employees of the contractor.
The court noted that the taxi service is responsible for life, health and safety of property belonging to a passenger, whether the transportation was performed by its own vehicle or the one rented alongside the crew.
