MOSCOW, May 31 - RAPSI. Microsoft has challenged the court decision to uphold only part of its lawsuit against Russian businessman Dmitry Shapovalov over the "windows.ru" domain name, the court told the Russian Legal Information Agency (RAPSI/rapsinews.com) on Thursday.
The Moscow Commercial Court reaffirmed the Microsoft Corporation's right to use the "Windows" trade name in its domain address.
Both the statement of reason and the operative part indicated that the corporation should be entitled to use the word "Windows" in the "windows.ru" domain name for Class 9 goods according to the International Classification of Goods and Services. On April 20 the court resolved to have the drawbacks rectified.
The court prohibited Shapovalov, who owns the domain, to use the Windows trademark in the domain name for this catageory of products. Shapovalov's website contained information about aircraft, avionics and other equipment that use the Windows trademark.
When announcing the decision, Judge Tatyana Vasilyeva noted that Shapovalov may use the domain for information on PVC windows.
Microsoft claimed the right to use "windows" in its domain name and sought to prevent Shapovalov from using it in his. Microsoft did not specify the class of goods for which the trademark should be prohibited from use.
Microsoft is the world's leading software manufacturer. In mid-November, its market value was estimated at $224.9 billion.
